Master Services Agreement & User Terms

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User") and EasyFaxOnline ("Company", "we", "us"). These Terms govern all access to and use of our web application, APIs, mobile integrations, and digital fax services.

2. Description of Service & Technical Role

The Service facilitates the digital submission, conversion, and routing of electronic documents to destination fax numbers over Public Switched Telephone Networks (PSTN) via underlying carrier partners. You acknowledge that the Company acts as a SaaS provider and internet transmission bridge, not as a primary telecommunications carrier.

3. Fair Use & Strictly Prohibited Uses

You agree to comply with all national and international regulations regarding commercial electronic messaging and telephony regulations, including the Telephone Consumer Protection Act (TCPA) and the Junk Fax Prevention Act.

Prohibited activities include but are not limited to:

• Transmitting unsolicited promotional material or mass advertisements without prior express consent.
• Forging headers, masking sender identification (Caller ID/CSID), or spoofing fax metadata.
• Transmitting unlawful, harassing, fraudulent, or defamatory content.
• Attempting to reverse engineer, overload, or bypass rate-limiting API mechanisms.

4. Transmission Reliability & Telephony Limitations

While our systems maintain a high delivery success rate, cloud faxing relies on legacy analog telephone lines, recipient device conditions, and external carrier switching. You acknowledge and accept that:

• Transmission Failure Factors: Fax delivery may fail due to recipient line busy signals, paper jams, power outages, noisy telephone lines, or misconfigured recipient fax machines.
• Page Calculation: A page is counted toward billing upon transmission attempt to the network gateway. Standard resolution pages taking longer than 60 seconds due to heavy graphic density or slow recipient baud rates may be billed as multiple page equivalents.

5. Billing, Credits & Subscriptions

A. Pay-Per-Page / Prepaid Credits

Prepaid fax credits entitle you to submit faxes at specified per-page rates. Prepaid credits are non-refundable except as explicitly outlined in our Refund Policy.

B. Subscription Tiers

Subscription plans renew automatically on a recurring monthly or annual basis. Recurring fees are billed in advance. You may cancel your subscription at any time prior to the next billing cycle through your dashboard.

6. Disclaimer of Warranties & Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, the company shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business interruption arising from transmission delays or failed faxes.

7. Termination & Account Suspension

We reserve the right to suspend or terminate accounts immediately for breach of anti-spam rules, fraudulent billing activities, or violation of applicable legal codes.
